二次創作についてのガイドライン

Guidelines for derivative work (fan art and music)

1.「スーパーバッハボーイ」（2020）、「もももも萌え萌え♡」（2021）の各楽曲、各キャラクターを用いた非商用目的の引用及び二次使用、創作性のある(*1)二次創作（同人音楽・「歌ってみた」、ファンアート）を認めます。出典を明記することを条件に、著作権者の許諾は不要です。

2. 違法な目的もしくは手段としての使用、又は、公序良俗に反する使用方法など、著作権者の意図に反する使用方法(*2)については、この限りではありません。

3. これに当てはまらない場合の二次使用については個別にお問い合わせください。

　*1) 創作性の有無について： ファンアートとしてご自身でお描きになったイラスト、同人音楽、「歌ってみた」等は、通常、典型的な「創作性がある」例と考えられます。既存イラスト、既存楽曲のデッドコピー（引き写し）的なものは、通常、典型的な「創作性がない」例と考えられます。

　*2) 著作権者の意図に反する使用方法：

1. キャラクターのイメージを著しく損なわないこと
2. 著作者の社会的な信用、評価を損なわないこと
3. 公序良俗に反しないこと
4. 他者の権利を侵害する、または侵害のおそれがないこと
5. 作者の公式かのような誤解を招くおそれがないこと

(1) Permission of the copyright holder is not required for non-commercial quotations, secondary use and creative(*1) derivative work(fan art, music("doujin music") etc.) using the music or characters of "SUPERBACHBOY" (2020) or "MOMOMOMOMOEMOE♡" (2021), provided that the source is clearly indicated.

(2) This does not apply to use for illegal purposes or as a means, or use contrary to the intent of the copyright holder(*2), such as use contrary to public order and morals.

(3) Please inquire individually about secondary use in cases not covered by the above.

　*1) Creativity: Illustrations that you have drawn yourself as fan art, "doujin music," "me singing," etc., are usually considered typical examples of "creativity. Dead copies of existing illustrations or music are usually considered to be examples of "no creativity".

　*2) Usage contrary to the intent of the copyright holder: 

1. The character's image must not be seriously damaged.
2. Not to damage the social credibility or reputation of the author
3. Not offensive to public order and morals
4. Not infringe or threaten to infringe the rights of others.
5. Not mislead people into thinking that it is the author's official work.
